General terms and conditions

If you are or want to become a member of ours and use our services or products, we would like to do so with clear and transparent agreements. By registering, you declare that you accept these general terms and conditions and the house rules of Best-Fit. The general terms and conditions and the house rules can be found on the website and can be requested at the counter of the club.

ARTICLE 1: DEFINITIONS

Best-Fit: By this we mean Best-Fit VOF and services and products that we offer under the name Best-Fit.
Club: the physical location where Best-Fit offers its activities.

Extra: These are the services or facilities that can be purchased from Best-Fit for a fee.
supplement to basic membership.

Coach: Our employee who is responsible for the management of the Club.

Lid: You can become a member if you are a natural person and 11 years or older. Best-Fit can ask you to
to prove by means of identification that you are the person to whom the pass belongs or to check your age.

Youth member: a natural person under the age of 18 who is a Member in his or her own name.

Agreement: the agreement that arises between Best-Fit and the Member through registration. This general
Terms and conditions also form part of your agreement, as do specific terms and conditions that may apply to an Extra.

Membership period: the period for which the Member enters into an Agreement. The duration of the Agreement
Member indicates at the time of registration or renewal and is tacitly renewed after this period with a
notice period of 1 month.

Fit: This is your access pass/wristband to enter our club.

ARTICLE 2: BECOMING A MEMBER

a. You can become a member of Best-Fit in the following ways:
1. On the website by completing the registration form;
or
2. At the club by completing the registration form.

ARTICLE 3: MEMBERSHIP, TERM

a. We have different types of membership, all details of which can be found on our website or at
the club. All memberships provide unlimited access during club opening hours and to the
group lessons offered at the club.

b. If you just want to try out our facilities, you can get a day pass at our counter by
leaving your name, phone number and email address. You can use the day pass once for free
of the fitness or a group lesson if there is space. If you want to use the club more often, you must
to take out a membership.

ARTICLE 4: EXTRAS

a. We offer an extra in addition to your membership form.

b. You can take an extra when entering into your agreement but also during the term of the agreement. An extra can also be cancelled at any time during the agreement. Cancellation is possible in the same way as you registered for the extra (via a form at the counter or via email to: info@best-fit.nl) with due observance of at least 1 month's notice during the term of the
agreement. The extra ends in any case at the end of the agreement.

c. The Extra is activated immediately so that you can use it right away. Articles 2 and 3 apply accordingly to the extras. If you choose an extra directly when you become a member, the costs of the extra are added to your membership so that both amounts are charged at the same time. If you take an Extra after the start date of your basic membership, it may be the case that the
costs for the extra and basic membership will not be debited in the same week.

ARTICLE 5: RATES AND PAYMENT

a. All membership types have their own membership rates and conditions, which can be found on the website or at the club.

b. When you become a member of Best-Fit we charge a starting amount. If you have terminated your membership and want to become a member again, you will owe a starting amount again.

c. When you become a member, you owe membership fees from the moment of registration. The starting amount will be collected immediately after registration. The membership fee will be collected immediately after the indicated starting date of the membership. All membership fees are due and payable in advance, in accordance with art. 5d and 5e.

d. If you choose a one-year agreement, the first period payment will take place in the first week of the start of the membership by a SEPA direct debit. If the agreement has been extended for an indefinite period, it can be cancelled at any time with a notice period of 1 month. Upon termination of the membership, the membership fee due for the last period will be refunded to the extent that
applicable will be collected pro rata.

e. If you opt for a 1-month agreement, the first payment after registration will be made by SEPA direct debit at the rates set for that membership. This flexible agreement is automatically extended for an indefinite period and can be cancelled at any time with a notice period of 1 month. Upon termination of the membership, the membership fee due will be
the last period, if applicable, will be collected pro rata.

f. Our collection period is always 1 month. This means that we carry out 12 collections per year.

g. If we are unable to collect your payment for any reason (e.g. chargeback, insufficient funds, etc.), we will send the collection again to your bank.

h. If you do not meet your payment obligation even after we have put you in default, you will be in default. At that time, we can charge collection costs and we can pass the claim on to a third party. We can also terminate the agreement with immediate effect. At that time, you will owe all membership fees that should have been paid during the term of the agreement plus the collection costs that are charged.

i. Once a year, we may increase our rates. If we make use of this, this does not entitle us to terminate the agreement. Rate adjustments due to government measures can be implemented immediately regardless of the amount and do not entitle us to terminate.

j. If you do not use the agreement or the extra, no refund of the membership fee will take place.

k. When a Youth Member reaches the age of 16, the Membership fee will automatically increase to the regular student rate.

l. When a student reaches the age of 22, the Membership fee is automatically increased to the regular rate. m. When a member is no longer entitled to an awarded discount, it automatically expires and the member pays the regular rate.

n. Changing to another membership is possible at any time, taking into account the period as indicated upon registration. The period of the new membership must be longer than the term of the current membership. A new membership period starts after changing membership.

ARTICLE 6: Membership wristband

a. The membership wristband is the property of the Member and may be used to gain access to the club.

b. You cannot transfer your membership to someone else. If you want to bring someone who is not a member, they can get a one-time day pass (these general terms and conditions also apply to day pass holders where relevant).

c. You are responsible and liable as a Member for the manner of use or misuse of the member wristband and membership. If someone other than yourself uses the member wristband, additional costs may be charged.

d. If you lose your membership wristband or if it is stolen, you can purchase a new membership wristband at the counter at the Club. This will automatically block the old membership wristband. The replacement fee for a new pass is €7.50. This fee must be paid by SEPA direct debit, after which the new membership wristband will be activated. In the meantime, your payment obligation will remain in effect.

ARTICLE 7: OPENING HOURS

a. Best-Fit indicates what the opening hours are. It is possible that different opening hours apply in certain circumstances. For example, in the event of calamities, holidays or force majeure.

b. We want to maintain our club well and sometimes we cannot avoid a temporary or partial closure. This may be the case if, for example, we have to carry out work in a club, or in case of force majeure. In that case you are not entitled to a refund of membership fees.

c. If, after a permanent closure or relocation of the club to a location further than 5 km from the old location, you can cancel the agreement free of charge and without notice from the moment of closure or relocation.

d. On certain days, the club may be unstaffed during certain hours. This will usually be between 1:00 p.m. and 5:00 p.m. During this time, there will be no supervision by a person physically present at the club.

ARTICLE 8: CHANGE OF GROUP LESSONS

a. We always want to keep our range of lessons up-to-date. This means that we regularly adjust the (content of the) lessons, the type of lessons and the lesson schedule. This can apply to both virtual lessons and live group lessons. Occasionally, a live group lesson may be cancelled. These adjustments or cancellations do not entitle you to a (partial) refund of the membership fee.

ARTICLE 9: RELOCATION OR INJURY

a. If you are moving, you can continue to exercise at our club. If your new home address is not within a radius of 10 km from Best-Fit, we will give you the opportunity to terminate your agreement prematurely, taking into account a notice period of 1 month, which starts at the moment of receipt of the termination. In that case, we will ask you to prove what your new home address is by sending a copy of the registration with
your municipality.

b. We hope that you will come to exercise with us in good health. If you are permanently unable to use your membership for medical reasons, you can suspend it. You must then provide proof that you are no longer able to use your agreement due to your medical situation, for example by means of a doctor's certificate. If, in the opinion of Best-Fit, the Member can demonstrate that, based on medical reasons, the agreement can temporarily not be used, the Member will be given the opportunity to suspend the agreement from the moment of notification until a previously agreed end date. The agreement will be temporarily suspended for a previously agreed period. The paid Membership fee will never be refunded. The agreement will be extended by the duration of the interruption. The agreement will be automatically reactivated immediately after the agreed end date.

c. Suspension of your membership for any other reason than described in art. 9b is not possible.

ARTICLE 10: TERMINATION OF MEMBERSHIP

a. If you have entered into an agreement for a period of one year, you can cancel it no later than 1 month before the end of the term. If you do not do so, the agreement will be extended for an indefinite period and can then be canceled at any time with a notice period of 1 month.

b. If you have entered into an agreement that can be terminated flexibly, you can terminate it at any time, taking into account a notice period of 1 month.

c. You can cancel your agreement in different ways. You can do this at the club by means of the
intended form or by sending an email to info@best-fit.nl.

d. We strive to create an environment in the club in which everyone respects each other and the rules are followed. If you do not adhere to the agreements of the agreement, or if you do not adhere to the house rules or display unacceptable behavior, Best-Fit can deny you access to the club and terminate the agreement (with immediate effect). The assessment of the situation is reserved exclusively for Best-Fit. Re-registering after such a denial is a valid reason to terminate the new membership with immediate effect.

e. Working out together is encouraged at Best-Fit. However, coaching other athletes at the club is exclusively left to the personal trainers with whom we work exclusively. It is therefore not the intention to offer personal training services ourselves.

f. If you grant another person, member or not, illegal access in any way, for example by letting them walk through the access gate or giving them your pass, Best-Fit may charge a fine equal to the value of a day pass and block access to the club until this fine has been paid. In the event of multiple violations, Best-Fit may terminate the agreement.

ARTICLE 11: RISK AND LIABILITY

a. Practicing sports can involve risks. If you use our facilities, you must assess what you can handle yourself. We offer active guidance by people at the club. You can hire a Personal Trainer, do a trial training or use the tips and advice that we provide in our app or via other means in the club. However, you always remain responsible for the way in which you exercise and the choices you make in this. The use of the facilities is at your own risk. In case of (doubts about) physical conditions, we advise you to seek expert advice from a doctor or specialist to determine what is the right and feasible way of exercising for you.

b. Best-Fit and our employees are not liable for material or immaterial damage as a result of an accident or injury that you sustain in our club.

c. We advise you not to bring valuables to the Club. Best-Fit provides lockers but use of these is at your own risk. Experience shows that no locker is safe from experienced thieves. Best-Fit accepts no liability for damage, loss or theft of your property.

ARTICLE 12: COMPLAINTS

a. We do our utmost to serve everyone and want to give as many people as possible access to sports facilities with our club. If you have any complaints, we regret that but we would of course like to hear about it. You can of course first contact the coach in our club and secondly to the management of Best-Fit.

ARTICLE 13: PERSONAL DATA

a. In order to implement your agreement, we have your personal data. Best-Fit processes your personal data in a proper and careful manner and within the framework of the applicable laws and regulations, such as the General Data Protection Regulation (GDPR).

b. The privacy statement of Best-Fit lists which data we process, for what purposes we do this and how the personal data is handled. It also explains how data subjects can exercise their rights to the processing of their personal data. The privacy statement of Best-Fit can be found on our website.

ARTICLE 15: APPLICABLE LAW AND DISPUTES

a. These general terms and conditions and all agreements entered into by or with Best-Fit are exclusively governed by Dutch law.

b. All disputes arising from the agreement between the member and Best-Fit will be judged by the competent court.

c. Best-Fit reserves the right to change the general terms and conditions at any time.
